  • JONATHAN KANTER

    This episode was recorded on November 18, 2024, the day when it was reported that Senior antitrust officials at the Justice Department plan to ask a judge to order Google to divest its Chrome web browser, Bloomberg reported citing anonymous sources. The department also intends to ask federal judge Amit Mehta, who declared Google's search engine a monopoly in August, to mandate actions concerning artificial intelligence and the Android mobile operating system. The enforcement actions are the product of the Justice Department’s multiyear case against Google which sought to prove that the tech giant has a web search monopoly in the U.S. The Justice Department won its case federal judge Amit Mehta ruled that Google broke antitrust laws in both online search and search text ads markets. The remedies are yet to be decided and will likely be fought in federal courts. Many parallels exist between this case and US v Standard Oil in the early 20th century and US v Microsoft in the early 21st century.

    The remarkable person leading this effort which at its root goes to the heart of free markets, power and competition is Assistant Attorney General of the United States’ Department of Justice Antitrust Division. He is deeply thoughtful and his mind is expansive, especially at the intersection of the law, free markets. Prior to this, Kanter worked as an antitrust attorney at the FTC and in private practice. AAG Kanter is considered a critic of “big tech” and DOJ has worked to block a record number of mergers on antitrust grounds. During his tenure, the DOJ won its first conviction in a criminal monopolization suit in four decades

    Jonathan has a very humble beginning in a working class neighborhood of Queens and graduated from SUNY Albany and Washington University School of Law. After graduating from law school, Kanter first worked as an antitrust lawyer at the FTC. He later worked in private practice, where he represented clients including Microsoft and Yelp as an associate at Fried, Frank, Harris, Shriver & Jacobson. Kanter was later a partner at Cadwalader, Wickersham & Taft followed by Paul, Weiss, Rifkind, Wharton & Garrison.

    Two other notable cases he has led include an antitrust suit related to JetBlue's attempted acquisition of Spirit, and one against Ticketmaster’s parent company Live Nation Entertainment. Upon filing the lawsuit, Kanter stated that "Live music should not be available only to those who can afford to pay the Ticketmaster tax".

    Much of his work, as was his confirmation by the United States Senate, has broad support across party lines, a rare thing in today’s Washington.

    Anilu Vazquez-Ubarri is a Partner and Chief Operating Officer at TPG, based in San Francisco. She is a member of the firm’s board of directors and executive committee. As COO, Anilu leads TPG’s operational functions globally and is responsible for aligning these functions and strategy with the firm’s strategic business and investment priorities. She previously served as the firm’s Chief Human Resources Officer, responsible for creating and implementing a multi-year human resources strategy that institutionalized TPG’s culture of inclusivity, transparency, entrepreneurship, and innovation.     Seth is co-founder and general partner at Boulder-based Foundry. He and his firm have invested in hundreds of companies and funds around the world. A driving force for Seth has always been the power at the intersection of community and business. He co-founded Pledge 1%, a global network of companies who have pledged equity, time, and product back to their local communities. He is on the board of StartupColorado, which promotes entrepreneurship in areas of Colorado outside of the front range and is a Trustee of Macalester College in St. Paul, MN, where he helped found their entrepreneurship program as well as a popular student hackathon.     This is the second of five from our “Experimental Series by A.I.” It is particularly interesting because it’s an A.I. generated conversation about A.I., the promise and peril of our relentless march towards AI → AGI (general) → eventually ASI (super). Top Of The Game fed Google’s NotebookLM five documents, links to the White House, MIT, Time, AEI and Google documents are below. The tool synthesized the conversation and it produced the podcast you are listening to. In fact, it is two different renditions of the inputs, you will notice where the first rendition ends and the second begins.

    We gave NotebookLM the inputs and the machine created this remarkably nuanced conversation. It is a primer at the intersection of technoethics + artificial intelligence + society + public policy + technology disruption.This conversation, or a version of it, is something almost everyone is thinking and talking about today.

  • TOTG EXPERIMENTAL SERIES BY A.I. // CAPITALISM

    Top Of The Game (TOTG) fed Google’s NotebookLM a few documents, one of them: Milton Friedman's September 1970 essay, "The Social Responsibility of Business Is to Increase Its Profits.". We also fed it a few published recently looking at the viability of the profit maximization a.k.a. shareholder primacy premise in the context of capitalism evolving and the tension of the stakeholder/shareholder push and pull. The jaw dropping synthesis NotebookLM produced is the podcast you are listening to. We gave it the inputs and the machine created a conversation, the future is happening now in other words.

    NotebookLM is a Google AI experiment that allows users to upload content - PDFs, text files, websites, YouTube video links, copied text, Google Docs and others. to a “notebook.” Each notebook is a folder that can contain dozens of discrete content items that you choose and control and of which one can ask questions, write new content based on the inputs, summarize and synthesize, basic but compellingly powerful inference analysis.

    One of things NotebookLM can produce as an output is an “audio overview”, essentially a conversational style podcast-like dialogue between a male and a female rendered personas. The summaries aren’t weird or artificial, nor robotic fact recitations. They are conversations, human sounding. The subjects pause, hesitate, summarize and conclude, use “ummms and ahhhs”, natural and eerily human interventions and interruptions. It’s in equal parts amazing and halting. This conversation about capitalism is the output of one such NotebookLM.

    Note: Our production company will continue to employ Javier to host the podcast. We are renegotiating his contract and hope to reach an agreement in the near future. Fans, stay tuned.

    Tom has been in the impact investing game for a long time. He was born and raised in East LA to two of the state’s most well-respected Latino Civil Rights leaders. His dad was Assemblyman Phil Soto, the first Latino elected to the state legislature in 1962. His mom was Nell Soto, she too served the last ten years of her life as a member and leader in the California State Senate. Impact runs through Tom’s blood.

    Tom has owned four PE funds, one of which, Craton Equity Partners, he sold to T.C.W., and leads his family investment office, Latimer Partners, LLC with his husband of 19 years, Todd Soto. The focus has been at the intersection of energy, climate tech, carbon monetization, renewable energy, and other Fourth Industrial Revolution driven platforms.

    He previously served as Chairman of the New America Alliance, founding Vice Chairman of the LA Clean Tech Incubator, Trustee of the California Science Center, Trustee of the NRDC, and Board Member of the Los Angeles Dodgers Foundation.

    Tom is also a former member of the board of trustees of the Redwood Mutual Fund, owned by Aspiration, the neo bank. He is a former appointee of President Clinton and served on Obama’s Presidential Transition Team focused on the Council on Environmental Quality.

Prior to joining Morgan Stanley she was the Global Client Segment and Strategy executive for Merrill Lynch Wealth Management.

    She has held leadership roles at the Association of Latino Professionals For America (ALPFA), Cherie Blair Foundation, Florida International University and Zoetic Stage. In 2017 and 2018, she was identified as one of the Top 50 Most Powerful Latinas in the U.S. by Fortune Magazine. On the Advisory Board of the Florida International University Honor’s College where students gain access to an education from one of the Top 100 Public Schools in the country. Ileana was recently named to ALPFA’s 2019 Most Powerful Latina list for a third year in a row and to Morgan Stanley’s 2019 MAKERS class.

    Ileana received her BBA degree, with a concentration in finance, from the University of Miami and an M.B.A. degree in Finance from Florida International University.

He is the Co-Founder & CEO of the National Association of Hispanic Real Estate Professionals (NAHREP ), one of the largest Hispanic business organizations in the nation. He also created the Hispanic Wealth Project, co-founded L’ATTITUDE, and is a general partner of its fund, L’ATTITUDE Ventures.

    A self-described serial entrepreneur, Mr. Acosta has founded several mortgage, real estate, and technology companies, including New Vista Asset Management, which, between 2009 and 2013, managed and marketed more than 10,000 real estate assets for banks and other financial institutions, CounselorMax, a web-based process management system for non-profit housing counselors, and RealEstateEspanol.com, an online real estate portal for Spanish-speaking Americans, which eventually sold to a publicly traded company.

    Gary served on the inaugural consumer advisory board (CAB) of the Consumer Financial Protection Bureau (CFPB) and was a member of the boards of directors of the Mortgage Bankers Association of America and Stewart Title Company of California. He writes a weekly blog about business and current events at garyacosta.com. Gary grew up in Montebello, California and attended the University of California, at San Diego and Pomona College, where he played varsity basketball for Hall of Fame Coach, Gregg Popovich.

  • EDUARDO PEÑALVER BIO

    Eduardo M. Peñalver is President of Seattle University and previously served as the Dean of Cornell Law School. A coming home of sorts given his formative years were spent in Puyallup and Tacoma.

    Professor Peñalver’s legal scholarship focuses on property and land use, as well as law and religion. His work explores the way in which the law mediates the interests of individuals and communities. His writing on property has appeared in numerous leading law journals. His book, Property Outlaws (co-authored with Sonia Katyal), published by Yale University Press in February 2010, explores the vital role of disobedience within the evolution of property law. His most recent book, An Introduction to Property Theory (co-authored with Gregory Alexander), was published by Cambridge University Press in 2011.

    Professor Peñalver received his B.A. from Cornell University and his J.D. from Yale Law School. Between college and law school, he studied philosophy and theology as a Rhodes Scholar at Oriel College, Oxford. Upon completing law school, he clerked for Judge Guido Calabresi of the United States Court of Appeals for the Second Circuit, and at the Supreme Court for Justice John Paul Stevens. Professor Peñalver previously served as the John P. Wilson Professor of Law at the University of Chicago Law School (2012-2014) and taught at Cornell Law School (2006-2012) and at Fordham Law School (2003-2006). He has also been a visiting professor at Harvard Law School and Yale Law School.

  • Cesar was a civil rights, Latino, farm worker, and labor leader; a religious and spiritual figure; a community servant and social entrepreneur; a crusader for nonviolent social change; and an environmentalist and consumer advocate. In 1968, Chavez gained attention as leader of a nationwide boycott of California table grapes in a drive to achieve labor contracts. He fasted for 25 days in 1968 to affirm his own personal commitment and that of the farm labor movement to non-violence. He fasted again for 25 days in 1972, and in 1988, at the age of 61, he endured a 36-day "Fast for Life" to highlight the harmful impact of pesticides on farm workers and their children.

    Cesar's life as a community organizer began in 1952 when he joined the Community Service Organization (CSO), a prominent Latino civil rights group. While with the CSO, Cesar coordinated voter registration drives and conducted campaigns against racial and economic discrimination primarily in urban areas. In the late 1950s and early 1960s, Cesar served as CSO's national director.

    Cesar's dream, however, was to create an organization to protect and serve farm workers, whose poverty and disenfranchisement he had shared. In 1962, Cesar resigned from the CSO to found the National Farm Workers Association, which later became the United Farm Workers of America.

    For more than three decades Cesar led the first successful farm workers union in American history, achieving dignity, respect, fair wages, medical coverage, pension benefits, and humane living conditions, as well as countless other rights and protections for hundreds of thousands of farm workers. Against previously insurmountable odds, he led successful strikes and boycotts that resulted in the first industry-wide labor contracts in the history of American agriculture. His union's efforts brought about the passage of the groundbreaking 1975 California Agricultural Labor Relations Act to protect farm workers. Today, it remains the only law in the nation that protects the farm workers' right to unionize.

    The significance and impact of Cesar's life transcends any one cause or struggle. He was a unique and humble leader, in addition to being a great humanitarian and communicator who influenced and inspired millions of Americans to seek social justice and civil rights for the poor and disenfranchised in our society. Cesar forged a diverse and extraordinary national coalition of students, middle class consumers, trade unionists, religious groups, and minorities.

    His motto in life – "Sí Se Puede!" (it can be done!) – embodies the uncommon and invaluable legacy he left for the world's benefit.

  • This bonus episode is President John F. Kennedy's first state of the union address to Congress on January 30, 1961, 10 days after his inauguration. It is also 13 days after President Eisenhower gave his farewell address and which this podcast released two weeks ago on August 7, 2024. It will be interesting for listeners to hear the two speeches back to back.

    In the speech President Kennedy discusses his concerns regarding the economic recession, the depreciation of the American dollar, the need for federal aid in education and scientific research, and Congress’ duty to respond to domestic issues, such as civil rights and clean water supplies. The President also discusses the possible spread of communism in Asia and Latin America, the need to restore peace in the Republic of Congo, and his plan for Cold War diplomacy, which focuses on the use of new military, economic, and political tools to meet potential challenges from the Soviet Union or Communist China.

  • LUIS MIRANDA BIO

    Luis Antonio Miranda Concepción is a political strategist, philanthropist, advocacy consultant and author, his latest book: "Relentless: My Story of the Latino Spirit That Is Transforming America” with a foreword by his son, Lin-Manuel Miranda.

    Luis was born and raised in Puerto Rico and moved to NYC at 19 when he received a scholarship from NYU. In the 1980s, Miranda was a special advisor for Hispanic Affairs to the Mayor of New York City, Ed Koch, serving as Director of the Mayor's Office for Hispanic Affairs. He also served on the Board of the NYC Health and Hospitals Corporation during the Koch, Dinkins (and as Chairman) during the Giuliani administration.

    He has served as a political consultant on several high-profile political campaigns, including Hillary Clinton. Miranda is a founding partner of the MirRam Group which focuses on political and advocacy consulting. Miranda was also a founder and first president of the Hispanic Federation in 1990 and served as director of field services and research at the National Action Council for Minorities in Engineering. He also held leadership positions at the Community Service Society, the NYC Department of Employment, the NYC Board of Education, and Aspira of New York. He is chairperson of The Broadway League's Latino audience development program, Viva Broadway. and the vice-chair of the Northern Manhattan Arts Alliance and a member of the advisory boards to Nielsen, board chair of the Latino Victory Fund and as a board member of The Gilder Lehrman Institute of American History, and NYC & Company.

    Siempre, Luis, a documentary directed by John James, is centered on Miranda and his years of activism. The film was a 2020 Sundance Film Festival Official Selection and premiered on HBO on October 6, 2020.

  • This bonus episode is President Dwight D. Eisenhower's farewell address to the nation on January 17, 1961 - three days before JFK's inauguration.

    When the United States entered WWII, Dwight D. Eisenhower was the Chief of Staff for the Third Army. Less than four years later, he was a 5-star general who commanded millions of soldiers, sailors, and airmen from a broad Allied coalition becoming one of the most influential generals in American history. Eisenhower planned and supervised two of the most consequential military campaigns of World War II: Operation Torch in North Africa and the invasion of Normandy in 1944.

    Following the German unconditional surrender, Eisenhower was appointed military governor of the American-occupied zone of Germany. Upon discovery of the Nazi concentration camps, he ordered camera crews to document evidence for use in the Nuremberg Trials.

    In 1948 he became President of Columbia University in New York City. In 1951 President Truman sensed a broad-based desire for an Eisenhower candidacy for president, and pressed him to run for the office as a Democrat in 1951. But Eisenhower voiced his disagreements with Democrats and declared himself to be a Republican. In 1952, Eisenhower won the election with an electoral margin of 442 to 89, marking the first Republican return to the White House in 20 years and won re-election in 1956.

    Under his watch, the Interstate Highway System was established, the Space Race kicked-off, we fought the Korean War which was a manifestation of the Cold War stance in the bi-polar world that served as a backdrop for the foreign policies of his administration.

    Eisenhower was born in Denison, Texas and raised in Abilene, Kansas. He graduated from West Point in 1915. During WWI he was denied a request to serve in Europe and instead commanded a unit that trained tank crews.
