President-elect Donald Trump has suggested he could rely on recess appointments to get his preferred cabinet picks into position if the Senate won't confirm them. But, some conservative legal scholars argue there's another — and untested — way around the Senate's constitutional role to provide "advice and consent" and it may lead to a clash.
This episode: senior White House correspondent Tamara Keith, national justice correspondent Carrie Johnson, and political correspondent Susan Davis.

The Harris campaign, which has been praised for how it has managed to reach out to women, is now having to balance their attention and pitch some policies that would appeal to men. But is it too little too late? As the nation’s chief law enforcement officer, he would direct the government’s legal positions on critical issues, including abortion, civil rights and first amendment cases. Gaetz has himself been investigated for sex-trafficking and sexual misconduct, although never charged. What else do we know about congressman Matt Gaetz and has his nomination got any chance of being voted through the Senate? Jonathan Freedland is joined this week by Chris Michael, the Guardian US live news editor

The Democratic party is hardly monolithic. But if there’s one thing that’s kept it together over the past decade, it’s been a shared opposition to Donald Trump. Now that Trump is returning to the White House, how will the party try to win voters back? The FT’s deputy Washington bureau chief Lauren Fedor and US national editor and columnist Ed Luce join this week’s Swamp Notes podcast to discuss how the Democrats are thinking about the future.
Mentioned in this podcast:
‘They don’t understand my life’: what the Democrats misread about America
How the Democrats can win in 2028

Today, we look at the resignation of the Archbishop of Canterbury Justin Welby.
He has resigned after growing pressure due to a report which found that he did not follow up rigorously enough on reports of abuse of young boys and men by John Smyth. In his resignation letter, he said the report "exposed the long-maintained conspiracy of silence about the heinous abuses of John Smyth”. Adam speaks to the BBC’s religion editor Aleem Maqbool to discuss what has changed in the past 24 hours to cause the Archbishop to resign and what it means for the Church of England.
