Donald Trump repeatedly has pledged to pardon the insurrectionists who attacked the US Capitol on January 6th and assaulted 140 police officers in their attempt to stop the certification of Joe Biden's election win and keep Trump in office. Judge Royce Lamberth just sentenced J6 defendant David Dempsey to 20 years in prison for his crimes of violence against police officers on January 6th. Another defendant told a judge at his arraignment, "Trump is going to be in office in six months, so I have nothing to worry about."

Special Counsel Jack Smith asked for a rare delay in Donald Trump's DC prosecution for trying to overturn the results of the 2020 presidential election. This development inspired speculation that Smith is now trying to delay the case or maybe that he's not up to the task of prosecuting Trump. This speculation is nonsense. Smith and his team have been going gangbusters after Trump and his criminal cabal. The reasons for the requested delay can be gleaned from the language Smith included in his motion to Judge Tanya Chutkan seeking the delay.
As a career federal prosecutor, Glenn had the experience of struggling to get the higher-ups at the DOJ to make decisions that would allow him to move forward in his cases. He includes his experiences in that regard.
Indeed, one of those experiences ended up as part of the 2019 movie "Georgetown" by Christoph Waltz.

We have to stop labeling Trump's pledges to end our democracy as "strange," "bizarre," and "unclear." Trump is telling us exactly what he intends to do. Donald Trump's longtime flunky, Steve Bannon, presently is serving a four-month prison term for defying congressional subpoenas in an effort to hide incriminating evidence about Donald Trump from the January 6th House select committee. Bannon was also federally indicted previously for conspiracy to defraud Trump supporters our of their money with a bogus "We Build The Wall" foundation. And Trump has such little regard for his supporters that he pardoned Bannon for those crimes. However, Bannon's scam also violated New York State law, and Manhattan District Attorney Alvin Bragg charged Bannon. Now, the New York judge presiding over Bannon's state case just set his trial date for December 9th, just over one month from the time Bannon will complete his federal prison term.

In the case of Trump v. United States, the Supreme Court quite literally ruled that portions of our Constitution are unconstitutional. This is a gross abuse of judicial power by six Supreme Court justices.
Kim Wehle is a law professor, a constitutional law and separation of powers expert, an ABC News legal analyst, a former federal prosecutor and the author of three books (links below), and a fourth book set to be released on September 2, that could not be more timely: "Pardon Power: How The Pardon System Works - And Why."
In part 3 of Glenn's conversation with Kim, they discuss, among other topics, Senator Whitehouse's formal request of Attorney General Merrick Garland that Supreme Court Justices Clarence Thomas and Samuel Alito be criminals investigated, as well as the articles of impeachment that have been drafted for the same two justices.
