(24:25) Realtors are paid commission at settlement and brokers always get a fee for the backend work of ensuring that the legal documents are processed correctly.

(25:43) Good realtors will be willing to discuss commissions and fees and other process details so that the seller and buyer clearly understand what’s involved.

  • Navigating the transition from a longtime home into a new place and the next stage of life is one of the biggest challenges older folks and their families face. Join Jeff and his guest, Andrew Bartlett, owner of the real estate firm Bartlett & Associates, to discuss ways to ease the transition. In addition to traditional real estate services, Andrew’s team can provide organizing, downsizing, cleaning, painting, moving, and other assistance to prepare the home for sale and make the move. The team further differentiates itself by offering Next Step Home Solutions, programs designed to provide fast, flexible financial help for those who need access to funds before their home sells.

Contact Andrew Bartlett at (717) 203-5528 or visit these websites:
Next Step Home Solutions - https://nextstep.care/
    Bartlett & Associates - https://www.lancorealestate.com/

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:19) Andrew entered real estate because he wanted to provide services that were better than what he experienced as a first-time home buyer.

(07:02) Bartlett & Associates offers two financial programs—a cash program and a bridge loan program—for when a customer needs funds right away.

(09:43) Often, conventional lender options are available only when people are moving from one house to another, not from one house to a retirement community or care home.

(13:32) Jeff added Life Care Planning services at Bellomo & Associates because so many people expressed a need for help with home safety assessments, community services, the long-term care system, etc.

(15:35) Professionals with a reliable and knowledgeable referral network can greatly benefit their customers.

(17:41) Andrew’s company is a sponsor of Bellomo’s Multi-Professional Boot Camps. By participating, Andrew came to realize the benefit of smart estate planning to protect one’s home and assets.

(24:31) Andrew's nonprofit—HCB Foundation—assists families with an urgent need for help paying rent, buying groceries, etc.

  • When people think about estate planning, a will is often the first thing that comes to mind. But relying solely on a will might leave significant gaps in your financial plan, potentially putting your loved ones and your hard-earned assets at risk. Join Jeff as he breaks down the critical features of a will and why a will alone might not be enough to protect your assets and your family’s future.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:20) While a will directs the distribution of assets in your name alone, it does not control assets with joint owners or designated beneficiaries, like insurance policies or jointly held bank accounts.

(07:46) Most financial institutions won’t allow a testamentary trust (a trust established within a will) to be named as a beneficiary. This limits your ability to protect those assets after your death.

(09:26) Assets passed outright through a will can be exposed to risks like Medicaid repayment, creditor claims, financial mismanagement, and future spouses via death or divorce.

(11:11) Probate can be costly, with legal fees often ranging from 4-6% of the estate. While you can handle probate without a lawyer, the executor still bears significant personal liability to ensure everything is handled correctly.

(18:12) Relying on beneficiary designations to avoid probate can leave assets unprotected, potentially exposing them to creditors, lawsuits, and financial missteps.

(21:45) Unlike a will, a properly structured trust can help you avoid probate, reduce fees, and provide ongoing asset protection for your heirs.

(24:12) The absence of a will triggers the intestate succession process. State law will determine who receives the estate, or what is left of it. Most often, this is the closest living relative.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(05:09) Nearly 80 social workers enrolled in our first boot camp because of the need to better understand the legal issues their clients were facing.

(06:49) The success and popularity of the boot camps made it clear that a multi-professional boot camp was needed. Nurses, nurse practitioners, administrators, CPAs, CFPs, insurance agents, and others can earn six (6) CEUs.

(09:00) Participants learn the basics of estate planning and more advanced concepts such as taxation, asset protection, probate v. non-probate, beneficiaries, and much more. Afterward, attendees enjoy a fun networking event, which can be especially worthwhile given the range of professions in attendance.

(10:36) Our take-home binder is a valuable guide that attendees keep among their most frequently used professional resources.

(15:25) We are grateful for our sponsors who enable us to provide our boot camp free of charge. Sponsorship opportunities are available.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:20) Jess joined the firm in 2022 as community outreach coordinator.

(05:56) Although she was happy in her non-profit job, Jess accepted Jeff’s job offer because she liked the firm’s mission—to help families.

(09:00) Jess has loved coordinating fun and educational events and helping clients see the value of the firm’s work.

(10:57) Initially, her role was not clearly defined, but Jess shaped it into a successful position.

(13:43) Olivia’s House is a grief and loss center for children. Jess’s husband, K.C., and Jeff's wife, Whitney, have become good friends through their work with the organization.

(14:26) Jess worked at Olivia’s House while in grad school. The organization depends heavily on well-trained volunteers.

(15:55) Whitney’s ongoing involvement in Olivia’s House is based on her desire to give back.

(19:02) Olivia’s House is always looking for volunteers and donations. The programs are free, so funding is needed to continue to provide support.

  • Selling a home usually means something big is happening—maybe it's a fresh start, a major transition, or closing one chapter to begin another. But for most people, selling a home can be overwhelming. That’s where Kasey King comes in. She’s the founder of Bodacious Properties, LLC, and she’s built a business around helping people navigate all aspects of a real estate sale with ease, no matter their stage of life. Jeff talks with Kasey about her work, her influences, and how she and her team add value by handling the fine details and the hard work needed during a big transition.

To learn more about all the services provided by Bodacious Properties, visit https://paestatesolutions.com/ or call Kasey at (717) 345-3444.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:00) Books by Robert Kiyosaki and T. Harv Eker inspired Kasey to learn the real estate business.

(05:44) Rather than “putting lipstick on a pig,” the goal of Bodacious Properties is to add value and make the home a safe living space.

(11:04) Kasey started in real estate doing standard “retail” work, helping buyers and sellers. An early client made her realize that many people need help with all aspects of selling a home.

(15:44) While most real estate agents will tell people how to stage a home for sale, Bodacious Properties does the work of preparing and staging in cooperation with the seller.

(17:29) Most of Kasey’s work comes via referrals, outreach, and her website.

(18:15) With industry knowledge and connections in local governments, Kasey’s team is especially helpful when time is tight, or a property becomes available under less than desirable circumstances.

(22:41) Kasey and Jeff recommend books by Wallace D. Wattles, Zig Ziglar, and Alex Hormozi. Ziglar’s philosophy is that you can get everything you want out of life by helping other people get what they want. Hormozi says you should provide so much value that people would be crazy to say no.

  • When it comes to estate planning, there are a lot of half-truths, outdated advice, and persistent myths that can leave your family vulnerable. Join Jeff as he clarifies common misconceptions about wills, probate, powers of attorney, and trusts. Estate planning is far from a one-size-fits-all exercise. Multiple tools are available, and to be most effective, they should be strategically customized to each family’s needs.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:02) Myth #1 – A last will and testament is good enough. Truth – A will outlines what will happen to our assets that are in our name alone. This leaves a lot of issues unresolved.

(04:42) Myth #2 – Avoid probate using joint ownership and beneficiaries. Truth – When money is distributed outright to the joint owner(s) at the time of death, it creates a situation where (1) the money can be spent before creditors and tax collectors get their share, and (2) assets become susceptible to unintended claimants.

(10:44) Myth #3 – Revocable trusts should not be used. Truth – They ensure flexibility during life, give the grantor complete control, offer options for disability planning, and provide after-death asset protection.

(19:45) Myth #4 – A revocable living trust is all you need. Truth – In some instances, an irrevocable pure grantor trust is a better option. It can offer more robust tax handling, leaves the grantor in control, and provides a step up in basis for the beneficiary.

(22:52) Myth #5 – Trusts are one-size-fits-all. Truth – There are many tools available to estate planners; it’s important to mix and match to develop a custom plan that is appropriate for each family.

(24:25) Myth #6 – A power of attorney (PoA) is good forever and any PoA is good enough. Truth – Most banks want these documents updated at least every two years. Also, to protect assets, a spouse or child must be specifically authorized in the PoA.

  • Things seem to be happening fast, and many people are worried about potential changes to tax laws and funding for programs on which they rely. Over time, Jeff has learned that talk of change does not always result in change. Because speculation can drive anxiety and poor decisions, often the best approach is to wait. If laws and programs do change, then meet with your professional advisor(s) and make decisions based on the most current and accurate information.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:48) We anticipate changes in 2026 to the federal estate tax limit for people who have at least $13.99 million as a single person or $27.98 million as a married couple. Be prepared to speak with your tax attorney in the last quarter of 2025.

(05:45) If you have less than $13.99 million or $27.98 million, hold off on making changes for tax purposes until we know more.

(07:40) Tax planning with an irrevocable trust means giving up control. Understand your options.

(12:00) Jeff is skeptical that they will make cuts to Medicaid.

(16:18) Schedule an appointment with your attorney if changes are made to same sex marriage laws.

(17:50) There is no harm in filing for The Corporate Transparency Act. If you wait, keep track of the filing deadline.

(19:21) If you have a grantor trust and have been filing separate trust tax returns, ask your tax professional if you should continue to do that. Pennsylvania now follows the federal rules.

(21:26) Changes to The Secure Act are possible. Wait to make adjustments until we know whether changes occur.

(23:28) One smart way to prepare for an unknown future is to make sure that everyone over the age of 18 has a financial power of attorney, a health care power of attorney with a living will, and a last will and testament.

  • Jeff is joined by Garrett and Angel from Country Meadows Retirement Communities for an important conversation about senior living—how providing a personalized approach to care and a comfortable home environment can make all the difference, and how it all starts with a passion for serving seniors. Their discussion offers a valuable perspective on what to look for and how to spot it when assessing retirement communities.

Visit https://www.countrymeadows.com/ or call (717) 741-5118 and ask for Garrett or Angel to learn more or schedule a tour.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(04:10) Country Meadows is home to seniors, a place where they receive help with everyday tasks and activities.

(05:04) Angel started with the organization 18 years ago as their memory care nurse. Garrett started as a 16-year-old working in the dining room while still in high school. He fell in love with the residents, and it prompted him to pursue senior care as his career.

(08:06) Family members don’t always have the knowledge or capacity to provide care for a senior at home.

(10:24) There are tremendous health benefits to the social aspects and opportunities in community living.

(12:32) Country Meadows offers multiple levels of care—supported independent living, 24-hour personal care, secured memory care, a restorative care neighborhood, and more.

(15:06) The organization is proud of its team of nurses, which is accountable to the Director of Nursing. Every level of care also has a Program Manager who helps to coordinate custom care based on individual needs.

(16:57) Country Meadows is family owned and operated. The organization prides itself on the dedication and longevity of its team members.

(22:04) When looking for a senior community, you can learn a lot by observing the care team. Do they appear to be well trained and happy? Do they interact well with each other and the residents?

  • Jeff speaks with Sarah Bucher, a team member at Legend of Lancaster, an exceptional assisted living, personal care, and memory care community. Their personal care and memory care services—including personal care needs, medical needs, medication assistance, and memory support—vary from person to person depending on what each individual wants and needs.

The team at Legend of Lancaster ensures that their residents are well cared for and that their staff members are experienced and meet the organization’s high standards. Join us for a look inside this special community that provides residents with assistance and support in the enriching, amenity-filled environment they call home.

You can learn more at https://legendseniorliving.com/

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:14) Sarah began her career at SpiriTrust Lutheran Home Care and Hospice in York. She’s been with Legend of Lancaster since 2019.

(06:45) Typically, Sarah meets people in the earliest stages of their involvement with the Legend community. She loves seeing how the residents thrive as they make friends and benefit from the programs and amenities that are available.

(09:11) When you’re someone who “loves hard,” you make true friendships and connections with people. It’s both a tremendous gift and very emotional to work with people in the latter stages of their life. But, it’s important to remember that, first and foremost, you need to be a support for the person and their friends and family.

(10:56) If needed, hospice can be provided on site in the resident’s home.

(11:51) The memory care neighborhood provides residents with independence and activities within a safe and secure environment. More structure for a resident’s activities can be arranged, as appropriate.

(14:52) It’s not unusual for a person to be reluctant to move out of their lifelong home. It's important to be honest as you help them understand the benefits of an environment such as Legend of Lancaster.

(22:03) When Sarah started at Legend of Lancaster, she was impressed by the organization’s structured approach to a compassionate philosophy that ensures a safe and enjoyable experience for all of their residents.

(25:29) The approach to those in need of memory care is to meet them where they are and get to know them as a full person, which includes the creation of a memory book.

  • It's natural for people to rely on professionals when it comes to complex subjects like finance, taxes, and estate planning and elder law. However, professionals can leave a client feeling overwhelmed or unsure by giving advice that the client doesn’t fully understand. So, the client lets the professionals make decisions for them. As a result, many clients agree to critical planning mistakes based on well-intentioned but misguided advice.

Jeff and the team at Bellomo & Associates believe you should be the one making key planning decisions because no one understands your circumstances and your goals better than you. That’s why our free, educational workshops are designed to help you understand the landscape so that you can make smart, informed decisions based on your family’s unique needs.

Join us as Jeff discusses how to get the most out of your work with professionals and the importance of making your own decisions.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:34) To be an effective advisor, you must understand that the client is the best person to decide on what’s best for their family.

(07:06) Professionals can, unknowingly, introduce their own biased judgment into your decision-making process

(09:11) No two families are the same and they're going to value certain things differently based on their experiences.

(14:39) Professionals should help you understand the situation, the consequences, the pros and cons, and the costs. They should present the facts on all sides of the issue.

(16:57) In our workshops, we make sure that attendees understand the risks associated with different options.

(22:27) Nobody knows what's going to happen in the future, so you determine what's important to you and your family, and then you decide what plan to put in place.

  • Are your affairs in order? Recent aviation disasters and the devastating wildfires in California are stark reminders that our lives can change instantly. No one wants to dwell on worst-case scenarios, but having a plan can provide peace of mind and protect your legacy and your loved ones if tragedy strikes.

Jeff shares practical steps you can take to prepare for the unexpected—from creating an estate plan to deciding on funeral arrangements and the distribution of meaningful family heirlooms. Not all pre-death planning requires a lawyer, but documenting and communicating clear wishes and intentions can ensure that your affairs are in order no matter what the future holds.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:30) When preparing for the unexpected, what type of planning will safeguard your assets and your family?

(06:03) Getting your thoughts in order and sharing them with your family can never be done too soon. Communicating can lessen concern, stress, and disagreements.

(09:41) Some illnesses take time to progress, which can provide the opportunity to plan. But with a sudden tragedy, it’s best to be prepared ahead of time.

(10:47) Bellomo & Associates’ building is equipped with fire and flood retardant storage to protect your original documents. Additionally, the documents are scanned and the digital versions are held offsite.

(12:12) Storing key documents with a professional can safeguard the documents from loss and also from those who might have less-than-honorable intentions.

(21:27) Not all planning requires the involvement of a law firm and not all discussions with family require that you share every detail. The important thing is to get everyone on the same page.

  • You may have been told by family, friends, or even your financial planner that you should avoid the probate process by adding a joint owner to your financial accounts and/or by designating a beneficiary for your assets. But be aware. While you save upfront costs, you lose control of your assets and open your family to unintended consequences, which can be much more costly in the long run.

There is a better way to avoid probate. We encourage you to share this discussion with the people in your life so that everyone understands the smart alternatives to avoiding the probate process.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(02:47) Probate is the legal process by which we carry out a person’s wishes at the time of their death when they own assets in their name only with no designated beneficiary.

(05:50) Some people want to avoid probate to avoid the associated fees. This can be a good strategy if done correctly.

(07:39) Avoiding probate does not avoid taxes.

(10:45) Joint ownership of assets or passing assets directly to a beneficiary can unintentionally undermine the wishes of the deceased.

(11:48) After the death of a spouse, joint ownership of assets during a second marriage can jeopardize the inheritance of the children from the first marriage.

(13:45) A Will does not go through probate if the assets named in the Will are jointly owned.

(16:06) Probate can be avoided when assets are transferred to a trust at the time of a person’s death. The assets are protected immediately, and they are not subject to the five-year lookback period for Medicaid eligibility.

(20:40) Trusts are a great way to protect your assets for your family’s use, avoid unintended consequences, and ensure that your wishes are honored.

  • At Bellomo & Associates, we are committed to client education. In this episode, Jeff discusses the differences between a Special Needs Trust and a Supplemental Needs Trust as part of that commitment. Our Special Needs Workshop offers another opportunity to learn these key concepts.

Our Estate Planning Workshop focuses on pre-planning activities such as Wills, Powers of Attorney, Asset Protection Trusts, etc.

If you or a loved one will need skilled care in the next six months to a year, our Medicaid Workshop would probably best serve you.

The Life Care Planning Workshop allows you to help a loved one age in place. Our licensed social workers share their valuable expertise with you.

After the loss of a loved one, you can attend our Administration Workshop where you’ll learn how to administer the estate properly.

Call (717) 845-5390 or visit https://bellomoassociates.com/workshops/ to learn more or register for our free, educational workshops.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(05:39) Our Special Needs Workshop looks at special needs trusts (also known as first-party trusts or payback trusts or d4A trusts), supplemental needs trusts (i.e., third-party special needs trusts), pooled trusts, ABLE accounts, and more.

(09:00) A third-party special needs trust is created and funded by someone for a person with a disability. A first-party special needs trust is created and funded by the person with the disability.

(10:47) The terms “special needs trusts” and “supplemental needs trusts” are essentially interchangeable.

(16:51) “First-party special needs trust” and “third-party special needs trust” are clearer terms and the rules for each are different. A first-party special needs trust provides for the state to get repaid up to the amount of care provided. A third-party special needs trust does not repay the state.

  • James Kabrhel, Ph.D., and Jeff Bellomo were college roommates more than 20 years ago and have remained good friends ever since. Today, Jim is an associate professor of chemistry at the University of Wisconsin–Green Bay. Jim and Jeff reflect on the importance of mentors, relationships, hard work, finding the right environment, and playing to your strengths.

Check out Jim’s science podcast: Baloney Detection with Dr. K.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(02:35) Raised in East Stroudsburg, Jim found a home away from home at Juniata College. In choosing a college, he recognized that a smaller school would be a better fit for him.

(06:05) Jim’s high school science teacher inspired his interest in chemistry. At Juniata, his chemistry professor deepened Jim’s desire to pursue chemistry as a career.

(07:51) Jim earned his Ph.D. in organic chemistry from the University of Minnesota, Twin Cities. The environment and his advisor had a tremendous influence on Jim’s ability to thrive.

(13:19) At Juniata, Jeff’s three roommates all studied the hard sciences, which led to some funny moments for him. Looking back, Jeff and Jim recognize that everyone has their own special set of strengths, but there is no substitute for hard work.

(16:35) Jim and his wife, Amy, first bonded over Harry Potter. Today they share a home in Wisconsin right on Lake Michigan.

(22:03) Higher education is going through an interesting time of change.

(23:37) Amy is also an associate professor. In addition to traditional chemistry classes, she and Jim teach sustainability chemistry, scientific literacy, and an intense organic chemistry boot camp.

(25:58) Jim’s research into pseudoscience and misinformation in product marketing is the focus of his podcast: Baloney Detection with Dr. K.

  • The focus on client education at Bellomo & Associates stems from Jeff’s commitment to ensuring that what happened to his family doesn’t happen to yours. When Jeff Bellomo was a law student and his mother was ill, the family needed information about care options and how to pay for them, but help was nowhere to be found.

Today, the free workshops offered by Bellomo & Associates set the standard for education in estate planning, crisis Medicaid planning, life care planning, special needs trust planning, and probate and trust administration. You can never have too much knowledge, education, or information. So, join Jeff as he describes our workshops and who should attend.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(03:43) Our Estate Planning Workshop is for those interested in pre-planning, as opposed to our Medicaid Crisis Planning Workshop, which is most appropriate when a loved one will need skilled care within the next six to 12 months.

(04:56) Skilled care means help with several daily activities (e.g., eating, bathing, dressing, toileting, transferring, or walking).

(05:57) When there is no immediate need for skilled care, attend the Estate Planning Workshop. Pre-planning gives you a jump on fulfilling the requirements of Medicaid’s five-year lookback period.

(10:09) At the end of our workshops, a team member will explain your options and the costs of planning. You are free to move forward with the process or not.

(15:41) Our Life Care Planning team includes two licensed social workers, a registered nurse, and other team members who are there to assist your family.

(21:54) Our Special Needs Trust Workshop is for those who are already receiving public benefits but will be losing the benefits due to an inheritance, settlement, excess income, etc.

(24:16) The Probate and Trust Administration Workshops help you understand what is needed to conduct probate or trust administration after your loved one has passed.

  • Putting your house in a trust has many benefits—from financial savings to peace of mind. You can continue to live in the home and control the property. You can avoid the capital gains tax, the 2% transfer tax, and the inheritance tax while still qualifying for the homestead exemption and the Clean and Green tax benefit. And, of course, a trust protects your assets to pass the wealth to your loved ones.

In this discussion, Jeff Bellomo—an experienced estate planning and elder law attorney with a master's degree in taxation—explains planning techniques for estates with a net worth in the $300,000 to $5 million range.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(02:40) A trust is a legal contract between three parties. The grantor creates the trust, the trustee controls it, and the beneficiary receives it.

(06:56) A grantor can also serve as the trustee and live in the home, much like a beneficiary. The grantor is taxed at individual income tax rates.

(08:01) As a trustee, a grantor can sell the home, buy another home, and avoid the capital gains tax if they live in the home two out of five years as their primary residence.

(08:53) If the trust provides only for lineal descendants or siblings, there will be no transfer tax. Use an experienced estate planner to still qualify for the homestead exemption.

(12:44) A grantor trust will not jeopardize the Clean and Green tax benefit.

(13:00) If there is a current mortgage on the primary residence, it can be added to the trust. Be sure to continue to pay on time.

(16:17) It's wise to create the trust when a person or a couple is younger so that the Medicaid five-year lookback period does not pose a problem.

(20:04) A trust allows the family to protect accumulated equity, access funds to enhance the grantor’s life, and keep the grantor in the home.

(21:35) Ultimately, a trust provides flexibility and peace of mind. The family knows that the grantor(s) and the house are protected.

    WHAT YOU NEED TO KNOW

    (00:00) Episode introduction.

(02:43) In 2025, the annual gift tax exclusion amount will be $19,000. The exemption amount will be $13.99 million for an individual or $27.98 million for a couple.

(08:15) To qualify for Medicaid, you must spend down your assets to either $2,400 or $8,000 depending on your income. If your monthly income is greater than $2,901, you can have $2,400 in assets. If your income is less than $2,901, you can have $8,000 in assets.

(09:38) The monthly personal needs allowance will be $60.00.

(10:03) For a married couple, the community spouse can keep 50% of the couple’s total assets—but no less than $31,584 and no more than $157,920.

(11:21) The community spouse will be allowed a minimum monthly income of $2,555. If the community spouse’s income is less than this amount, they may keep a portion of their spouse’s income to reach the minimum. The maximum allowable monthly amount will be $3,948.

(11:57) Gifting money during the Medicaid five-year lookback period can cause a delay in Medicaid eligibility. The 2025 penalty divisor will be 399.80.

(13:37) The minimum home equity exemption will be $730,000. The maximum will be $1,000,097.

(14:10) The home maintenance deduction will be $989.10. The heating standard will be $750 or $401 for non-heating. The excess monthly allowance will be $767. The Medicare Part B premium will be $185.

(15:15) Some current tax rules are expected to sunset at the end of 2025.

(19:28) Beware of recent trends in estate planning. Choose only experienced and licensed estate planning and elder law attorneys to help you develop a plan that protects your family’s financial future.
