Federal Court Justice Richard Mosley wrote that while the protests "reflected an unacceptable breakdown of public order," the invocation of the Emergencies Act "does not bear the hallmarks of reasonableness â justification, transparency and intelligibility."
Ultimately, there "was no national emergency justifying the invocation of the Emergencies Act," he wrote.
The Federal Court case was argued by two national groups, the Canadian Civil Liberties Association and the Canadian Constitution Foundation, and two people whose bank accounts were frozen. They argued Ottawa did not meet the legal threshold when it invoked the legislation, which had never been used before.
The act gave law enforcement extraordinary powers to remove and arrest protesters and gave the government the power to freeze the finances of those connected to the protests. The temporary emergency powers also gave authorities the ability to commandeer tow trucks to remove protesters' vehicles from the streets of the capital.
Under the Emergencies Act, a national emergency only exists if the situation "cannot be effectively dealt with under any other law of Canada." Further, a public order emergency can be declared only in response to "an emergency that arises from threats to the security of Canada that are so serious as to be a national emergency."
The act defers to the Canadian Security Intelligence Service's definition of such threats â which includes serious violence against persons or property, espionage, foreign interference or an intent to overthrow the government by violence.
"The potential for serious violence, or being unable to say that there was no potential for serious violence was, of course, a valid reason for concern," he wrote. "But in my view, it did not satisfy the test required to invoke the Act, particularly as there was no evidence of a similar 'hardened cell' elsewhere in the country, only speculation, and the situation at Coutts had been resolved without violence."
Mosley's decision also examined one of the most controversial steps taken by the government in response to the protests â the freezing of participants' bank accounts.
"I agree with the [the government] that the objective was pressing and substantial and that there was a rational connection between freezing the accounts and the objective, to stop funding the blockades. However, the measures were not minimally impairing," he wrote. The judge said the economic orders infringed on protesters' freedom of expression "as they were overbroad in their application to persons who wished to protest but were not engaged in activities likely to lead to a breach of the peace."
He also concluded the economic orders violated protesters' Charter rights "by permitting unreasonable search and seizure of the financial information of designated persons and the freezing of their bank and credit card accounts."

MP Frank Caputo says he doesn't have enough support from other members of Parliament to investigate the federal governmentâs use of the Emergencies Act in response to the 2022 Freedom Convoy protests in Ottawa.
Following the ruling, Caputo and three other Conservatives on the Standing Committee on Justice and Human Rights issued a letter calling for a special meeting to address the ruling.
âWeâre in a situation where the court says that the government violated its own citizens Charter rights," Caputo told Castanet Kamloops. "And that's never a good situation."
Caputo, along with Rob Moore, MP for Fundy Royal, Larry Brock, MP for Brantford-Brant and Langley-Aldergrove MP Tako van Popta signed off on the letter. NDP MP Randall Garrison from Esquimalt-Saanich-Sooke and the Bloqâs RhĂ©al Ăloi Fortin form Riviere-du-Nord, who also sit on the committee, did not sign.
The 11-member committee consists of five Liberal MPs, four Conservatives, one NDP and one Bloc Québécois member. In order to hold the meeting, at least five votes were needed, but neither the NDP nor the Bloc Québécois members were interested in signing off

The emergency declaration was supposed in the House of Commons by the Liberals and New Democrats. Trudeau revoked the emergency before the Senate voted on it.
Poilievre trumpeted the decision when it was handed down, saying Trudeau âbroke the highest law in the land with the Emergencies Act.ââHe caused the crisis by dividing people. Then he violated Charter rights to illegally suppress citizens. As PM, I will unite our country for freedom.â

Liberal gun control bill passes Senate, becomes law

Bill C-21 passed the Senate without changes on Thursday, becoming law on Friday.
The version that made it to the Senate was significantly expanded from what the federal government had initially tabled a year prior.
Bill C-21 passed by a vote of 60 to 24(opens in a new tab), and with applause in the upper chamber.
The legislation includes measures to:
Tighten gun laws to include "red flag" and "yellow flag" provisions related to a gun owner posing a risk to themselves or others;
Impose a "freeze" on the sale, purchase or transfer of handguns in Canada;
A prospective Criminal Code "technical definition" of what constitutes a prohibited assault-style firearm, meant to "cement in law" a permanent ban on future models once the bill comes into force; It would include a firearm that is not a handgun that discharges centre-fire ammunition in a semi-automatic manner and that was originally designed with a detachable magazine with a capacity of six cartridges or more.
However, the definition would cover only firearms designed and manufactured after the bill, known as C-21, comes into force. It would not affect the classification of existing firearms in the Canadian market, the government says.
A series of provisions meant to make it illegal to make or buy ghost guns and to combat firearms smuggling; and
Wording making clear the government's intent to uphold Indigenous treaty rights.
The bill also includes a requirement for a parliamentary review of the technical definition five years after it comes into effect, while a series of other related measures are being advanced through regulations.
after six sitting months that included a dozen days of study at the Senate National Security, Defence and Veterans Affairs Committee, where 66 witnesses were heard from(opens in a new tab), Bill C-21 passed the Senate without amendment.
Though, senators did submit several observations about the bill, including that the government should consider "additional policy measures," to address outstanding concerns, such as implementing a Canada-wide database and data collection process regarding all gun-related injuries and death, and consulting further with sport shooters.
Witnesses emphasized that several potential harms associated with owning a firearm would not be fully
addressed by Bill C-21, including harms such as domestic violence and suicide. Consequently, the
committee recommends that the Government of Canada undertake careful analysis and consideration
of these potential harms, and develop comprehensive, tailored and integrated policy measures to be
implemented alongside Bill C-21.
The committee recommends that the Government of Canada, in consultation with suicide prevention
experts, consider whether information regarding mental health literacy, suicide and suicide prevention
â including firearms-specific information â should be included in Canadian Firearms Safety Courses.
The committee recommends that the Government of Canada immediately develop and implement a
Canada-wide database and data collection process regarding all gun-related injuries and deaths. This
database and data collection process should be developed in consultation with the medical community
most experienced in treating gunshot injuries and recording firearms-related deaths
The committee understands that Bill C-21 would create additional rules in relation to handguns.
Specifically, with some exceptions, new registration certificates for handguns would not be issued and
the transfer of handguns would be limited.
Witnesses made comments about the effects that Bill C-21 would have on the ability of handgun
owners to bequeath collectible handguns that have sentimental value to immediate family members.
For these owners, the results could include stress, anxiety and anger.
The committee encourages the Government of Canada to work with handgun owners to try to find
solutions that could address this issue while both preserving public safety and maintaining the spirit of
the legislation.
Witnesses expressed various views about the implementation of exceptions that would be granted to
handgun shooting sports that are Olympic and Paralympic disciplines. There is concern that members of
sport shooting organizations who fall outside of these defined terms will be unable to apply for an
exception to compete in their sport. The committee encourages the Government of Canada to consult
with all sports shooting stakeholders to ensure that regulations relating to Bill C-21 would guarantee
the continuity of handgun shooting sports that are Olympic and Paralympic disciplines in Canada, and
would ensure the existence of continued pathways for athletes of all skill levels to continue in these
Disciplines.
The committee is aware that Bill C-21 would include a new definition for the term âprohibited firearmâ
in subsection 84(1) of the Criminal Code, with this proposed change designed to restrict certain new
semi-automatic centre-fire firearms. There would be no impact on firearm models created before the
proposed definition comes into force. Having heard Minister of Public Safety, Democratic Institutions
and Intergovernmental Affairs Dominic Leblancâs comments about the re-establishment of the
Canadian Firearms Advisory Committee, the committee wishes to express its support for a
comprehensive ban on âassault-style firearmsâ that are not reasonable for use when hunting. From that
perspective, the committee recommends that the Government of Canada expeditiously proceed, by
order in council, to ban existing assault-style firearms.
Given the total absence of meaningful consultations, the government drafted a bill which will have no
meaningful impact on firearms crime in Canada.
Apart from certain measures, such as provisions related to ghost guns and the sharing of information
that may facilitate 3D firearms printing, no components of Bill C-21 tackle the growing problem of gun
crime in Canadian communities. Instead, the entire focus of the bill is on firearms owners who hold a
restricted firearms licence and who are engaged in varied shooting sports or collecting.
The government claims that, by banning the sale and purchase of legal handguns, it will reduce the
supply of such firearms in Canada and thereby reduce the possibility that these particular firearms
could be misused or stolen.
There is no evidence to support this assertion. Witnesses who appeared before our committee
repeatedly stated that nearly all handguns that are criminally used in Canada are smuggled firearms.
âBy removing the ability to enter the sport, new shooters are struggling to acquire the equipment to participate. Bill C-21 is requiring athletes to prove they are training for the Olympics before they even start into the event. It makes no sense. Athletes rarely start off a new sport with the sole purpose of making the Olympics. Sport is intended to promote activity for life. Why are we putting such an additional pressure on the shooting sports only to produce Olympians? Participation in other shooting sports provides an avenue to enter into the International Shooting Sport Federation, the ISSF events. It covers a greater opportunity for competition than just Olympic events. There are more events within the ISSF World Championships that are contested at the world games. Bill C-21 removes the option to compete at an international competition just because the Olympic Games has now a limited subset of what the ISSF covers.â

The federal government hopes to avoid gumming up the works of its new dental-insurance plan by gradually phasing in enrolment over the course of the next year
Seniors over the age of 87 will be the first cohort to be able to apply to join a new federal dental-insurance plan.
It will be slowly expanded over the course of 2024 to include all qualifying seniors, children under the age of 18 and people with disabilities.
Holland announced the rollout of the program, which is currently budgeted to cost $13 billion over the next five years
The program is aimed at people with an annual household income under $90,000 who don't have access to private insurance.
Coverage will include preventive, diagnostic, restorative and surgical services â including X-rays, fillings, root canal treatments and dentures, among others
Once eligibility is expanded to all qualifying Canadian residents in 2025, it will be the government's largest social program.
The insurance plan is a key pillar in the Liberal's supply-and-confidence deal with the New Democrats to secure the opposition party's support on key votes.

In 2022, a report estimated the overall food price increases would be between five to seven per cent â the latest data from Statistics Canada pegs the food inflation rate at 5.9 per cent.
In the latest edition of the annual report, the authors believe the overall rate of inflation will be lower in 2024, falling to somewhere between 2.5 and 4.5 per cent.
According to Charlebois, things are "much calmer now," which could result in more deals and potentially some price wars between the big grocers.
"Margins are going to be everything," he said. "And because consumers don't have any money now, grocers will be fighting for our business."
Over the next year, Charlebois believes grocery stores will be offering more incentives to consumers like loyalty programs and deals to entice people.
One of the tactics used is selling items at a loss, which brings the customer through the grocer's doors, but then the store would increase the prices for other items, hoping the consumer will buy those as well, he explained.

The Public Health Agency of Canada says 129 people have been confirmed with salmonella linked to the outbreak, almost double the number at the last update on Dec. 1, when a single death had been recorded.
There are also 17 cases in Ontario, 15 in British Columbia, and two each in Prince Edward Island, New Brunswick and Newfoundland and Labrador.

The Hospital Appeal Board has found that Dr. Theresa Szezepaniak's refusal of the shot in 2021 amounted to neglect of her obligations as a hospitalist at Royal Inland Hospital, and the decision to take action on her privileges was appropriate.
"The appellant [Szezepaniak] says that IH is required to respect her exercise of her Charter rights," an appeal board panel wrote in a Nov. 20 decision.
"The implication is that in order to respect her decision IH must not take any steps that hold the appellant accountable for the consequences of that decision. Having the right to make a decision, and your right to do so acknowledged, or respected, is not the same as being held responsible for the consequences."
in other words, the decision says, Interior Health didn't challenge Szezekpaniak's right to refuse the vaccine, but it did hold her accountable for the fact that choice left her unable to work under provincial law.

Poland's education minister says he has "taken steps" to effect the extradition to Poland of Yaroslav Hunka, a 98-year-old Ukrainian Canadian, after it emerged that the veteran served in the Nazi SS Galizien formation during the Second World War.
Robert Currie, a law professor at Dalhousie University and an expert in extradition law, told CBC News Canada does not have a formal extradition agreement with Poland. "That doesn't prevent extradition. It just makes it a matter of more paperwork between the two governments," he said.Currie said Canada and Poland can agree to extradition in Hunka's case. Before that transfer could happen, he added, Poland would have to present evidence that Hunka committed a crime that Canada would recognize â he could not be extradited on the basis of his membership in the Nazi SS Galizien formation."We do not have crimes of association other than organized crime type-offences which are very, very specialized," he said.
Other challenges to extradition in Hunka's case, Currie said, include his advanced age and the question of whether he is fit to stand trial. Hunka could also challenge any extradition in court, a process that could take years.
The Netherlands refused an extradition request from Poland in 2020, citing concerns that judges in that country were not sufficiently independent of the Polish government. "When you have the government interfering with the courts, that gives the appearance of the potential for a fair trial being endangered, and that is an argument that a person can make [to avoid extradition]," Currie said.
B.C. Conservative leader under fire for likening teaching of sexuality, gender to residential schools

Who started calling residential school burial sites mass graves?

In the spring of 2021, a series of ground-penetrating radar surveys near the sites of former Indian Residential Schools uncovered anomalies that appeared to be consistent with childrenâs graves. In the nationwide protests that followed, more than 60 Canadian churches were vandalized or destroyed, and statues were pulled down in virtually every major city.
The surveys would help spawn a new holiday, Truth and Reconciliation Day, prompt an official visit by Pope Francis and result in Canadian flags being kept at half-mast for a record-breaking five consecutive months.
And then, just last month, an excavation at the Pine Creek Residential School in Manitoba determined that 14 âanomaliesâ suspected to be childrenâs graves were actually nothing. To date, of the hundreds of suspected graves identified starting in 2021, Pine Creek is the only one that has been followed up with an archeological dig.
The preliminary claims of First Nations performing the surveys did not state that these were âmass graves,â that they were deliberately concealed or that they were the result of homicide. At least in the beginning, the claims of âmass gravesâ or mass murder would stem mostly from foreign news outlets.
When the Cowessess First Nation in Saskatchewan announced a survey showing 751 unmarked graves near the site of the former Marieval Indian Residential School, Chief Cadmus Delorme was careful to say they were not a mass grave. Rather, these were plots within a larger Catholic cemetery whose headstones Delorme said had been removed by Catholic authorities. âThis is not a mass grave site. These are unmarked graves,â he said.

In July, Prime Minister Justin Trudeau and German Chancellor Olaf Scholz met with their NATO allies in Vilnius, Lithuania, where they pledged their âenduring commitment to invest at least two per cent of our gross domestic product (GDP) annually on defence,â noting that, âin many cases, expenditure beyond two per cent of GDP will be needed in order to remedy existing shortfalls and meet the requirements across all domains arising from a more contested security order.â
A few months before reaffirming his commitment to it at the summit, Trudeau reportedly told NATO members behind closed doors that Canada would never spend two per cent of GDP on defence. And indeed, late last week, we learned that his Liberal government is looking to cut $1 billion from the annual defence budget, which would further reduce the measly 1.3 per cent of GDP this country spent on defence last year.
Speaking in front of a parliamentary committee on Thursday, Defence Minister Bill Blair said that, âThe fiscal environment in Canada right now requires that when we are spending Canadian taxpayers dollars ⊠we do it carefully and thoughtfully.â And heâs absolutely right. But it seems a little rich from a government that canât seem to go a week without announcing millions in funding for high-speed internet in some remote part of the country or to virtue-signal for the woke cause du jour, and wastes tens of billions on its fruitless quest to forcibly decarbonize the economy.
Having a military thatâs capable of defending your countryâs sovereignty may not seem to be âcreating public value for Canadians,â as Blair suggested government expenditures should be, and may not be a vote-getter like dental or child care, two areas Treasury Board President Anita Anand insinuated the government needs to find savings in order to fund.

Mr. Savaryn, a former chancellor of the University of Alberta, was appointed to the Order of Canada in 1987 by governor-general Jeanne Sauvé. Previous governor-generals also awarded him Golden Jubilee and Diamond Jubilee medals in 2002 and 2012.
Governor-General Mary Simon has apologized for the appointment to the Order of Canada of Peter Savaryn, a veteran who served in the same Nazi-led Waffen-SS division as Yaroslav Hunka. The statement apologized for the distress his appointment to the Order of Canada may have caused. It said her office is also probing his Jubilee medals, which are awarded to Canadians who have made a significant contribution to the country.
âIt is with deep regret that we acknowledge that Mr. Peter Savaryn was appointed to the Order of Canada in 1987, and we express our sincere apology to Canadians for any distress or pain his appointment may have caused,â the office said in a statement, adding that it had elapsed on his death in 2017. âThe Chancellery is committed to working with Canadians to ensure our honours system is reflective of Canadian values.â
Separately, Prime Minister Justin Trudeau told reporters Wednesday that senior public servants were looking into publishing the full report of the DeschĂȘnes Commission, which examined claims that Canada was playing host to war criminals.
âWe have made sure that there are top public servants who are looking very carefully into the issue, including digging into the archives, and theyâre going to make recommendations to the relevant ministers,â the Prime Minister said.
Savaryn was a leading Progressive Conservative in Alberta and prominent member of Edmontonâs Ukrainian community who championed multiculturalism and played a key role in establishing schools with Ukrainian-language instruction. He also set up the Edmonton branch of the Ukrainian scout group Plast, whose participants included Chrystia Freeland, now Deputy Prime Minister.
In a 2013 interview with the newspaper Ukrainian Weekly, Ms. Freeland recalled attending the youth group there. âPlast was a very important part of my life growing up,â she said. âI grew up in a Ukrainian community and was active in Plast.â

The University of Alberta says it is reviewing other donations it has received after returning $30,000 from the family of Yaroslav Hunka
The university is facing calls to return hundreds of thousands of dollars in endowments in the names of Ukrainians linked to the Waffen SS. They include an endowment of about $430,000 in the name of Volodymyr Kubijovych, who played a key role in the SS unitâs establishment in 1943.
Per Anders Rudling, an expert in the Waffen SS Galicia division, who studied at the University of Alberta, said for the sake of âconsistencyâ the university should return other donations from SS veterans to fund Ukrainian studies
He said it did not make sense just to return $30,000 from the family of Mr. Hunka, who was a teenager at the time he volunteered to fight with the Waffen SS division, while keeping money from more senior figures.
University of Alberta spokesman Michael Brown said last week it has decided to âclose the endowment fund that existed in Mr. Hunkaâs name and return the funds to the donor.â âWe are currently reviewing other endowments, and our general naming policies and procedures, including those for endowments, to ensure alignment with our values,â he said in a statement.
the university should also return donations in the names of other former Waffen SS veterans, including $50,000 from the family of Levko Babij. His donation was designed to fund the study of 20th-century Ukrainian history, especially during the Second World War. Prof. Rudling said Mr. Babij was a former president of the Ukrainian veterans association.
The university also received a $15,000 donation from Roman Kolisnyk, who was an officer with the rank of untersturmfĂŒhrer in the Galicia Waffen SS division, and editor of the journal of the Ukrainian Waffen SS veterans. After the war he settled in Toronto. Established in 2011 by Mr. Kolisnyk, the fund is worth around $100,900 and supports translations and publications of Ukrainian literary works, memoirs and diaries.
The universityâs Canadian Institute of Ukrainian Studies, which their donations helped fund, refers in past newsletters to their service with the SS Galicia division.
Veterans of the SS regiment have also held positions at the University of Alberta. They include Peter Savaryn, who became its chancellor. In 1987
Mr. Savaryn is one of around 12 former members of the Nazi-led Waffen-SS Galicia division with endowments, awards and donations in their name at the university, according to Dr. Rudling.
The universityâs Canadian Institute of Ukrainian Studies has received endowments and donations worth over $1-million from Ukrainians who served in the Waffen-SS Galicia division or who helped set it up, according to research by professor Per Anders Rudling of Lund university, Sweden, an expert on the division.
Historical context stuff
Mr. Savarynâs obituary in the Canadian Institute of Ukrainian studies newsletter explained how as a 17-year-old he joined the division, after being summoned with his brother by his father âwhen Hitlerâs drive to the East faltered in 1943 and the Soviet military began its relentless counter-offensive.â His father told him he was left with two options: âeither âgo to the woodsâ to join the Ukrainian partisans fighting the Germans Poles and Sovietsâ or enlist in the Galicia division.
In the decades after the Second World War the divisionâs veterans debated whether creation of the formation had been a mistake, whether their idea of breaking from the Germans at the warâs end and becoming the core of a Ukrainian army had been a fantasy, and whether they had in fact been a German and not a Ukrainian army,
The Galicia division was set up by Heinrich Himmler, the head of the SS, from Ukrainian volunteers after the German defeat at the battle of Stalingrad, to try to stem the Soviet advance. Soldiers swore an oath to Hitler and the divisionâs newspaper was infused with antisemitic and National Socialist propaganda. An edition days before the soldiersâ surrender in 1945 claimed Jews were plundering Ukraine.

The letter and subsequent coverage expressed the groupâs anger over Bill C-21, which the group described as âlamentable.â
In a March 18 French-language article published by Radio-Canada, PolySeSouvient accused Trudeau of âabandoningâ and âbetrayingâ victims of Canadian gun violence over the governmentâs announcement of a voluntary âbuy backâ program for certain firearms, instead of mandatory confiscation, which PolySeSouvient had demanded.
The letter to Trudeau from the group, translated from French, had said: âIf you continue with this bill, we will never again welcome you alongside us when we mourn the death of our daughters, sisters and friends during the annual commemorations.â
Later that year, the Trudeau government adjusted its policy so that its initial voluntary buy back became the mandatory confiscation the group had been demanding. It is in the process of becoming law.
That letter and attached fact sheet â claimed that not going all-in on confiscating firearms from licensed owners was a reversal of previous election promises vowing to âinitiate a buyback program for all assault weapons,â and blamed Canadaâs âgun lobbyâ for fomenting trepidation over supposed failures in New Zealandâs firearm confiscations following the 2019 Christchurch shootings in New Zealand. It also refuted criticisms that the confiscation would adversely impact First Nations people, as they would be given a special amnesty of two years to replace their newly banned firearms.
âUnder a volunteer buyback program, countless fully functional assault weapons would remain in circulation, which could be stolen or used by their owners for violent purposes,â read the letterâs attached note.

The Chinese government likely was behind a "spamouflage" disinformation campaign targeting Prime Minister Justin Trudeau, Conservative Leader Pierre Poilievre and other MPs in August and September, says Global Affairs Canada.
A "spamouflage" campaign is one which uses a network of new or hijacked social media accounts to post propaganda messages across various platforms, such as Facebook, X/Twitter, Instagram, YouTube, Medium, Reddit, TikTok and LinkedIn.
The department's Rapid Response Mechanism (RRM), which was set up to monitor foreign state-sponsored disinformation efforts, said the campaign was "connected to the People's Republic of China" and was meant to curb criticism of the communist regime.
According to a report released Monday morning, the propaganda campaign began in August and targeted dozens of MPs from across the political spectrum.
An email from GAC officials to the affected MPs said 47 of them from across Canada were targeted. The email advised MPs on how to protect themselves from foreign interference and assured them the campaign did not present a threat to their safety.

So there may be, possibly, unlikely, episode 400 of CPP tonight. I started listening around 200. And I enjoyed it, mostly. But hold on a second. 400 - that is about 8 years. So since 2015. When libs got elected. Coincident? I don't think so. I think it is part of LPC strategy to win hearts and minds across all platforms. Pay legacy media, start social media channels. How likely is it that all that liberal bashing did not result in cancelling CPP podcast and channel? It must be a cover up. The hosts are undercover feds. Watching who tunes in and building a list. Ragnarok Tactical? Another way to collect names and addresses of people who buy unacceptable merch. Listener meet-up? Let's see who comes, what they drive, what they say outside of internet where everything can be traced and stays forever. It is a setup! It's obvious who the real problem is now!
