Special Judge Fran Gull has rejected efforts by Richard Allenās attorneys to overturn his murder conviction in the Delphi murders case, denying multiple defense motions aimed at securing a retrial. Despite Allenās conviction and sentencing to 130 years in prison for the 2017 murders of Liberty "Libby" German and Abigail "Abby" Williams, his attorneys continue to argue that key evidence was withheld and new information has surfaced.
In an order dated Feb. 14, Gull denied the defenseās Verified Motion to Correct Error, a request filed on Jan. 20 seeking to vacate Allenās conviction. She also denied a second motion filed on Feb. 14 to strike the stateās response, as well as a motion to correct the abstract of judgment. These rulings were entered into the case record on Feb. 18 and were made without a hearing.
The defenseās latest challenge revolves around an Indiana inmate, Ricci Davis, who claims that two menāRon Logan and Kegan Klineāconfessed their involvement in the murders. Logan, who owned the land where the girls were found, allegedly admitted to Davis that he committed the murders and provided details only the killer would know. Davis says Kline, a convicted child pornographer, later corroborated Loganās statements and expressed relief after Allenās conviction, believing it would keep him from being a suspect.
Davis claims he sent as many as eight letters to Carroll County Prosecutor Nick McLeland during Allenās trial, detailing what he was told. He also alleges that he provided a recorded interview to police. However, Allenās defense team has never seen these letters or the interview, and McLeland has refused to confirm whether they exist or were shared with the defense.
āRicci Davis was shocked to learn that Baldwin had never received this videotaped interview,ā the defense wrote in their motion, referencing a conversation between Davis and Allenās attorney, Andrew Baldwin, in February 2025.
The defense has accused McLeland of withholding evidence and failing to disclose whether the letters and recorded statements exist. Baldwin said he repeatedly asked for clarification but received no response from the prosecution.
"McLelandās response was vague, non-responsive to the defense request and did not indicate whether he ever received those letters, nor whether he sent those letters to the defense," the defense motion states.
Prosecutors have countered that Allenās attorneys had the opportunity to present evidence at trial and that Davisā claims are unreliable. The state revealed that Davis āmiserablyā failed a polygraph test when pressed about Loganās alleged confession.
Davis, who is serving a 50-year prison sentence for meth distribution, admitted that he initially withheld some details in 2024 because he was unsure whether Allen was one of the men involved. However, in their February 2025 conversation, Davis told Baldwin that he later realized Allen was not the third person involved and tried to alert prosecutors.
Now, Allenās defense team is pushing for the letters, interview recording, and any related communications to be preserved and turned over. They argue that the information could impact Allenās conviction and support their claims that he is innocent.
Meanwhile, various media outlets have filed motions requesting the public release of certain case records, adding further pressure to the already contentious legal battle.
With Judge Gullās latest rulings, Allenās conviction remains intact, but his defense team continues to challenge the stateās handling of evidence. The case remains active as both sides await further court rulings.

For the first time since the 2017 Delphi murders, the state of Indiana has released crime scene photos, shedding new light on the evidence used to convict Richard Allen in the deaths of 13-year-old Abby Williams and 14-year-old Libby German.
The photos, included in a legal response by Carroll County Prosecutor Nicholas McLeland, show different angles of Libby Germanās cellphone before it was collected as evidence. The same phone recorded the infamous "bridge guy" video, which played a crucial role in the case. Prosecutors argue the images reinforce their claim that environmental factors, such as water or dirt, could have impacted the phoneās functionality. However, Allenās defense team disputes this, insisting the phone was manually activated even after it had reportedly stopped moving.
Allen, 52, was convicted in November and sentenced to 130 years in prison for the killings. His attorneys have since filed a Motion to Correct Errors, arguing that multiple issuesā including forensic concerns, Allenās treatment while in custody, allegedly false evidence, and an alleged confession from another manā warrant a new trial or the overturning of his conviction.
Defense attorney claims safekeeping order was illegal
Allenās lawyers have long argued that his pretrial detention at the Westville Correctional Facility, where he spent significant time in solitary confinement, severely impacted his mental health and ultimately influenced the trialās outcome. They describe the safekeeping order that placed him in the facility as āplainly illegal from start to finish.ā
In response, McLeland dismissed these concerns, stating, āThe motion for safekeeping does not touch on matters of guilt or impact the ability to have a fair trial, it is a mechanism for housing the Defendant in a penal facility pending trial that will keep him and others safe.ā
Surveillance footage and allegations of false evidence
The defense has also pointed to newly surfaced surveillance footage from near the crime scene that they claim contradicts the prosecutionās timeline of events. According to Allenās attorneys, jurors were presented with false evidence during the trial.
McLeland, however, has pushed back, stating that the video is āunverified by legitimate meansā and lacks an Indiana State Police identification number. As a result, he argues, it is āan improper submission for consideration by the Court.ā
Alleged 2017 confession by another suspect
Another major argument in the defenseās motion revolves around an alleged confession by Ron Logan, the late owner of the property where Abby and Libby were found. According to Indiana State Police records from 2017, Logan allegedly gave a detailed account of how he killed the girls.
Allenās attorneys argue that excluding Logan as a third-party suspect was a critical mistake by the court. However, McLeland downplayed the confession, stating that the person who reported it to police āfailed the polygraph miserablyā and that āmany of those details are directly contradicted by the evidence.ā
Prosecutors push back against new trial request
McLeland has urged the judge to deny the defenseās motion outright, arguing, āThe Defense is not permitted to request a new trial to change strategy when their chosen path fails.ā
Former prosecutor and current defense attorney Brad Banks echoed this sentiment, predicting that Allenās request will be swiftly denied. āI wonāt be surprised if this was denied pretty readily,ā Banks said. āI think thereās somewhere close to 0% chance any of this gets granted.ā
NBCUniversal fights for public access to evidence
In a separate legal development, NBCUniversal has filed a motion requesting that all trial evidence and exhibits be made public. The media company had previously submitted a public records request seeking access to materials in the case, but the state denied that request.
