Depending on where one stands, Adnan Syed is either guilty of murder or a victim of a justice system that has wrongly convicted and imprisoned him now for over half his life. Adnan was arrested at aged 17, denied bail, and was convicted of his ex-girlfriend's murder, Hae Min Lee, in 2000. In a new HBO docuseries, Adnan said that it was an ‘unstoppable force of sadness’ after Hae was murdered, and then he was arrested that February and charged. ‘It’s almost like there’s a flood outside your house, before you even come to terms with that, now there’s a fire inside your house,’ Adnan explains. How the jury managed to surpass “reasonable doubt” in this case is beyond belief. There are at least three viable suspects that could have murdered Hae—THREE! As you listen to Adnan’s case, see if you can rule any of them out.

Sir William Blackstone said in 1765, “It is better that ten guilty persons escape than that one innocent suffer“. Blackstone’s principle is a cornerstone of criminal law. That’s why we presume people to be innocent until proven guilty. John Adams expanded on that principle and predicted the state we are in now:
It is more important that innocence should be protected, than it is, that guilt be punished; for guilt and crimes are so frequent in this world, that all of them cannot be punished…. when innocence itself, is brought to the bar and condemned, especially to die, the subject will exclaim, ‘it is immaterial to me whether I behave well or ill, for virtue itself is no security.’ And if such a sentiment as this were to take hold in the mind of the subject that would be the end of all security whatsoever
It’s a tragedy that so much of our American justice system seems determined to thwart that principle these days. We are so intent on throwing people into jail that guilt or innocence doesn’t much matter.

Crosley Green, a 62-year-old man who has been fighting for his freedom for decades, is now facing a new hurdle—a coronavirus outbreak at his prison. Crosley Green's murder conviction was overturned in 2018, and his attorneys have filed an emergency motion for his release.
Crosley Green was supposed to be released 2 years ago but he was kept in prison because a Florida attorney general appealed that decision. And now his attorneys fear for his health. Crosley’s case is unlike other cases because he has had a Federal court rule that he was wrongly convicted. So based on what the court has ruled, Crosley shouldn’t be in prison at all. As of today, his attorney are unaware of his condition other than there has been an inmate that has tested positive for the coronavirus in his cellblock. They have no way to communicate with him at this time.
In Crosley’s filings, his attorneys wrote, “If Mr. Green dies of Covid-19, it will be a miscarriage of justice of unconscionable proportions.” This statement was released on August 10, 2020. As of that date, the number of inmates that tested positive was 144, it had more than doubled in TWO DAYS.

In this episode, Debra Fulton, Case Review Manager for Wrongful Convictions News, presents the case of Julius Jones. She discusses what was used against Julius to obtain a guilty verdict, including incentivized witnesses. There was plenty of doubt in this case, but yet Julius is still sitting on death row.
In this case, like so many others, “It’s important to understand how someone who has money is able to buy their way out of jail or prison, so you’re much better off in our justice system if you’re rich and guilty than if you’re poor and innocent,” said Sam Brooke, the Deputy Director of the Southern Poverty Law Center, in the article You’re Better Off ‘Rich and Guilty Than Poor and Innocent', in The Crime Report.
Most likely if Julius would have been financially comfortable, this case would never have seen the inside of a courtroom in the first place, as the identification would have excluded him—game over.
How is it just that the State gets to play the game with a Professional All-Star team while the defense has to play with nothing but a mere little league team? The saddest part of that question is the lack of hyperbole. The DA in Julius' case, Cowboy Bob Macy, Oklahoma County district attorney for 21 years, was famous—or should I say infamous—for being the second deadliest DA in the United States; unfortunately, he thought that was a compliment. Alas, almost half of his cases would go on to be overturned. While on the opposite side of ‘justice,’ Julius Jones, lacking the funds for the exorbitant fees it costs for a high-priced private attorney, wound up with a public defender who had never tried a death penalty case before and also had 70-80 other cases at the same time—Professional All-Star team…little league team! Got it?
