    In addition, the Baldwin defense has abruptly decided to withdraw several of its planned witnesses, for reasons the prosecution suggests indicate that these defense witnesses would testified in a manner harmful to Baldwin.

  • In today's show we cover the Courtney Clenney Arthur hearing testimony of the lead investigator, Detective Brecino. Specifically, we cover Brecino's cross-examination by Defense Counsel Frank Prieto.

    Overview:

    This week we're covering "OnlyFans Killer" Courtney Clenney, who on April 3, 2022 killed her boyfriend Christian Obumseli with a knife in their Miami apartment. Obumseli suffered a single knife wound to the chest.

    Clenney would tell investigators that the much larger and heavier Obumseli was a domestic abuser, and had pinned her to the wall by her throat and thrown her to the ground. She somehow managed to escape, move 10 feet away, grab a small kitchen knife, and toss it in his direction.

    That knife managed to penetrate Obumseli's chest, severing carotid arteries, and quickly leading to his death from massive blood loss.

    Although investigators initially perceived the event as an act of self-defense, they quickly began to suspect otherwise. Much evidence emerged that Clenney had been a violent abuser in the relationship--indeed, it seemed that she had previously stabbed Obumseli on an earlier occasion, simply because she was angry that he had stayed late to watch the overtime of a football game. There also emerged video of Clenney attacking Obumseli with her fists in an elevator.

    Ultimately Clenney was charged with second degree malice murder by Florida prosecutors, and she is in jail awaiting trial on that charge today.

    In late 2022 Clenney sought pre-trial release, offering to stay under house arrest with her parents in Texas. Florida prosecutors disagreed, and a motion was filed for an Arthur hearing. This is a Florida-specific hearing that is essentially a mini-trial, in which prosecutors have to prove by a strong presumption that the defendant is likely to be convicted at trial (Phase 1) as well as that the defendant is a flight risk if released (Phase 2).

    The Arthur hearing was held on Tuesday, November 15, 2022, and Thursday, November 17, 2022, with key testimony primarily from the lead investigator and the medical examiner on those two days, respectively. Spoiler: On December 8, 2022, the hearing judge would ultimately deny pre-trial release. Nevertheless, the testimony of these witnesses provides us with insight into how the evidence is likely to be presented at the actual trial.

    Over the next few Law of Self Defense shows I will be working our way through those two days of Arthur hearings and testimony.

  • A week ago last Friday, on May 17, Judge Mary Marlow Sommer, presiding over the manslaughter trial of Alec Baldwin in the shooting death of cinematographer Halyna Hutchins on the set of low-budge western movie "Rust," heard oral arguments around the defense team's motion to dismiss the grand jury indictment on a number of grounds.

    This motion was, of course, contested by Special Prosecutor Kari Morrissey. Although my own legal sense is that the motion was without substantive merit, it was interesting to observe Judge Sommer go rather hard at Prosecutor Morrissey on some of the key arguments raised by the defense team.

    I covered that oral argument here at Law of Self Defense last Saturday, May 18.

    Nevertheless, last week Judge Morrissey issued her ruling denying the defense motion to dismiss the grand jury indictment, and so we will be proceeding to the actual manslaughter trial, with jury selection scheduled for July 9 and the trial proper scheduled to begin July 10.

    I will, of course, be live streaming the trial for its duration.

    Today we dig into Judge Sommer's denial order, and see to what extent it tracks with my own legal reasoning on the dismissal of the indictment arguments on each side.

  • A New York City liquor store owner finds two men stealing, and shoves them out the door onto the sidewalk. A verbal dispute continues, and one of the thieves charges at the store owner standing in his doorway, punching and kicking.

    The store owner then follows the thief out onto the sidewalk, and throws a right hand at the thief.

    In that right hand, however, was a pistol, and it discharges as the blow lands, resulting in a gun shot wound to the thief. Presumably the shot is unintentional.

    The store owner has now ben charged with two counts of assault and is looking at 7 years in prison. (The thieves have been charged with petit larceny, and are looking at 1 year each.)

  • Is it possible that pointing what one knows to be a real gun at another human being, cocking the hammer, pulling the trigger, contrary to all industry practices and safety guidelines, and without first ensuring there is no live ammo in the gun, and killing someone as a result, is simply not a crime?

  • Yesterday Judge Mary Marlowe Sommer, presiding over the upcoming manslaughter trial of Alec Baldwin, for the killing of cinematographer Halyna Hutchins on the set of low-budget western movie "Rust," held a hearing to resolve a motion by Baldwin's highly paid defense team asking that the grand jury indictment against their client be dismissed.

    Arguing counter to that defense motion is prosecutor Kari T. Morrissey. Morriseey also prosecuted the manslaughter charges against "Rust" armorer Hannah Gutierrez, whose trial was also presided over by Judge Sommer. Gutierrez was found guilty of involuntary manslaughter, and sentenced to the maximum of 18 months by Judge Sommer.

    The Baldwin defense team has filed several motions demanding that his indictment be dismissed, largely on grounds that seem spurious. Nevertheless, they are being highly paid to advocate zealously for their client, and this challenge of the indictment is part of that defense.

    Yesterday Judge Morrow finally heard the oral arguments of the parties, as a final step before she issues a ruling on the defense motion to dismiss the grand jury indictment--and THAT'S what we'll be covering in today's show.

  • Yesterday, May 16, Texas Governor Greg Abbott issued a full and complete pardon to Daniel Perry, on the recommendation of the Texas Board of Pardons and Paroles.

    Perry had been convicted of the murder of AK-47 armed Black Lives Matter protestor Garrett Foster during a 2020 BLM protest in Austin TX. The jury rejected Perry's claim of self-defense, and Perry was subsequently sentenced to 25 years in prison.

    Although Gov. Abbott had soon after the trial promised to pardon Perry if the Board of Pardons so recommended, I'd personally expressed some skepticism that a pardon would ever actually issue--not for legal reasons, but for political reasons.

    Now that a pardon has issued, the firestorm of outrage over this case has re-ignited. Is the Governor's pardon a lawless genuflection to racist fascism, as the Progressive Left claims?

    Or is the pardon simple justice for an American serviceman who was merely exercising his Second Amend right to bear arms and his legal privilege of self-defense, and whose conviction was itself unjust?

  • Two days ago, Attorney William Kirk, the President of law firm Washington Gun Law, released a YouTube video on his extremely popular channel (~360,000 subscribers) providing legal analysis of the tragic shooting death of Roger Fortson.

    The title of that video: "The Florida Man Who Was Executed for Exercising His Constitutional Rights." (Find it here: https://youtu.be/IWepSw11YiA?si=_mxXs...)

    Given that this analysis was by a fellow attorney popular with the gun community, I eagerly looked forward to his analysis.

    It was, to say the least, disappointing. Indeed, a good case can be made that the video not only failed to provide anything resembling sound legal analysis, it was rife with emotionally-laden misinformation.

    Indeed, the video makes zero--as in zip, zilch, none--reference to any relevant Florida law that would determine if Fortson's shooting was legally justified. Not a word.

    In my opinion, criminal defense lawyers in particular should do better when covering such high-profile, emotionally-charged use-of-force events.

  • On Friday, May 3 a Florida deputy responded to a domestic violence call. Arriving at the apartment complex the deputy was met by the woman who'd made the call, who directed him to apartment 1401, in which she believed the violence to be occurring.

    The deputy knocked on the door, standing on either side for purposes of safety. When the door opened, the deputy was presented with a man with a gun plainly visible in his hand.

    The deputy immediately drew his service pistol and shot the man, killing him.

    That man would turn out to be Roger Fortson, a US Airman who was not, in fact, involved in a domestic violence event, and who by all accounts was doing nothing illegal at all when fatally shot by the deputy.

    Fueled by the usual lies of race baiter Benjamin Crump, as well as by visions of how the world might be if perfect, the internet is hysterical with outrage.

    Could this tragic shooting nevertheless be lawful? Is it necessarily murder? Manslaughter? Or is it simply not a crime at all under the law of self-defense?

  • On Monday, April 29, 2024, around 1:30 p.m., the U.S. Marshals Fugitive Task Force was attempting to serve active felony warrants for unlawful felon gun possession and felony flight to elude on 39-year-old convict Terry Clark Hughes, Jr.

    As officers approached, Hughes began firing at them, striking multiple officers. The officers responded in kind, and the gunfight was on.

    By the time the smoke cleared, Hughes was dead. Unfortunately, eight of the officers involved had been short, four of them fatally.

    Today we'll take a look at a variety of legal questions that arise from these kinds of engagements including: Is the suspect's home the safest place to secure their arrest? Can it ever be lawful to shoot at police? Should a felon who has served their time regain their gun rights? And much more!

  • An Ohio police officer responds to a call of a man walking around a residential neighborhood pointing a gun at homes.

    As the officer pulls up, he sees a suspect that matches the description called in.

    The officer begins to verbally engage with the suspect--and within seconds has fired a shot as he spots an apparent gun in the suspect's hand. The apparent gun would later be determined to be a toy.

    Ohio happens to be an Open Carry state, meaning it is lawful to openly carry a firearm in public.

    Does that make this officer's shooting of this suspect unlawful? What if it is determined that the suspect had only the most innocent of intentions in possessing that apparent gun.
