    Unfortunately, Jeffs died in a motorcycle crash on September 30, two months before the trial could proceed.   • Kouri Richins, a Utah children's book author accused of fatally poisoning her husband with fentanyl in 2022, will remain behind bars after a judge denied her bail request. Richins, who wrote a book on coping with grief called *Are You With Me?* following her husbandā€™s death, faces charges of aggravated murder and attempted murder.

    During a hearing in Utahā€™s 3rd District Court, Judge Richard Mrazik outlined his reasons for rejecting Richins' bond request. ā€œThere simply are not reasonably available means of mitigating her risk to the community and to herself or the strong incentive for her to flee the jurisdiction of the court,ā€ Mrazik said. He emphasized the severity of the charges and her diminished ties to the community as critical factors in his decision.

    Prosecutors accuse Richins of spiking a cocktail she made for her husband, Eric Richins, with a lethal dose of fentanyl. They also claim she attempted to kill him previously, on February 14, 2022, by giving him a drugged sandwich. Eric Richins, a father of three, died at their home near Park City, a small mountain town known for its scenic beauty.

    Richins was arrested in 2023, just a year after her husband's death, and gained further attention for her public appearances discussing her familyā€™s grief. Her book, marketed to help children deal with the loss of a loved one, has become a focal point in media coverage of the case.

    The defense team, led by attorney Kathy Nester, argued that the case against Richins is weakening. ā€œWith two charges dismissed and four others severed, the defense stands more confident. The case against our client is rapidly narrowing, exposing deeper weaknesses with each step,ā€ Nester said.

    Judge Mrazik dismissed two counts of distributing a controlled substance and agreed to separate four real estate-related fraud charges from the upcoming murder trial. However, he denied a motion from the defense to try the murder and attempted murder charges separately. The judge also refused a motion to increase the jury size from the standard eight to twelve members. Despite acknowledging that Utahā€™s law ā€œmay be on the wrong side of history,ā€ Mrazik said he is bound by his oath to uphold it.

    The trial, set to begin in April 2025, will cover multiple charges, including aggravated murder, attempted murder, two counts of filing fraudulent insurance claims, and one count of forgery. To ensure a fair jury pool, both the prosecution and defense agreed to select jurors from a broader geographic area, spanning Salt Lake and Summit Counties.

    Richins' defense team emphasized her connections to the area and disputed the notion that she poses a flight risk. However, Judge Mrazik pointed to several concerns, including her loss of business and strained relationship with her children, which he said could increase her motivation to flee.

    "Structurally, she just doesn't have the same connections to the community that she had then," the judge concluded. Richins remains in custody, awaiting her day in court, as both sides prepare for what promises to be a closely watched trial.

  • Kouri Richins, the Utah mother accused of spiking her husbandā€™s cocktail with a fatal dose of fentanyl, has made her first public comments since her arrest last year. In a series of jailhouse statements provided exclusively to "Dateline" this week, Richins criticized prosecutors, asserted her innocence, and described recent upheaval in the case as ā€œforced.ā€

    Richins, 34, who has been held in the Summit County Jail since a judge denied her bail last year, expressed frustration over being separated from her family. ā€œIā€™ve been silent for a year, locked away from my kids, my family, my life, living with the media telling the world who they think I am, what they think Iā€™ve done or how they think Iā€™ve lived,ā€ she said. ā€œAnd itā€™s time to start speaking up. You took an innocent mom away from her babies. And this means war.ā€

    The comments come after a judge granted her lawyers' request to withdraw from her defense against charges of aggravated murder and other crimes in the death of her husband, Eric Richins, 39, on March 4, 2022. Richinsā€™ lead attorney, Skye Lazaro, cited an ā€œirreconcilable and nonwaivable situationā€ as the reason for the withdrawal.

    In one statement, Richins said she was filled with ā€œgreat devastationā€ over her defense team's withdrawal. ā€œMy defense team has been forced to withdraw from my case. Represented or not, we all know and should understand thereā€™s only so much I can say. But what I will say is this withdrawal was not my choice. And it was not a personal choice of any counsel on my defense team.ā€

    The withdrawal request was filed the same day Richinsā€™ lawyers asked a judge to disqualify prosecutors due to ā€œsevere violationsā€ that compromised their defense and violated Richinsā€™ constitutional right to effective counsel. The filing alleges that from May to December last year, authorities recorded jail calls between Richins and her lawyers without their consent, some of which were listened to by prosecutors.

    When defense lawyers discovered the practice and questioned prosecutors, Summit County's top elected prosecutor, Margaret Olson, initially denied awareness. However, lead prosecutor Brad Bloodworth later claimed that one of the defense lawyers had refused to use a phone app that shields attorney-client calls, resulting in the recordings. Bloodworth asserted that prosecutors had not listened to the calls and suggested that by not using the app, the lawyer had seemingly consented to the practice.

    Richins accused prosecutors of doing "anything they can to prolong this process and hide their corruption. I will not play into the prosecutionā€™s unconstitutional behavior anymore." She expressed a strong desire to clear her name, stating, ā€œAlthough I am extremely disappointed where weā€™re at right now with this case, Iā€™m anxious. Iā€™m anxious to prove my innocence. Iā€™m anxious to get to trial.ā€

    Olson's office responded to the allegations, labeling the defense lawyer's motion to disqualify prosecutors as "materially inaccurate" and "filed in bad faith." The county attorney's office plans to address the motion formally by May 31.

    Prosecutors allege that Richins, deeply in debt, fraudulently obtained a nearly $2 million life insurance policy on her husband before giving him a Moscow mule spiked with a lethal dose of fentanyl. They also charged Richins with attempted murder, forgery, and mortgage and insurance fraud.

    One year after Eric Richins died, Kouri Richins published ā€œAre You With Me?ā€ a childrenā€™s book about grief, dedicated to her ā€œamazingā€ husband. Despite the charges, Richins and her family have maintained her innocence.
