Buster Murdaugh, son of convicted murderer and fraudster Alex Murdaugh, has filed a defamation lawsuit against Netflix, Warner Bros. Discovery, and several other parties. The suit, lodged in the Court of Common Pleas in Hampton County, South Carolina, claims that the documentaries "Murdaugh Murders: A Southern Scandal," "Murdaugh Murders: A Deadly Dynasty," and "Low Country: The Murdaugh Dynasty" wrongfully implicated him in the 2015 death of 19-year-old Stephen Smith.
The lawsuit, filed last Friday, also names Gannett, the publisher of the Hampton County Guardian, the newspaper’s editor, Michael Dewitt, Jr., and the production companies behind the documentaries. Murdaugh argues that the defendants defamed him by subtly or explicitly suggesting his involvement in Smith's death.
Buster Murdaugh, who testified at his father’s trial regarding the shock of his mother, Margaret “Maggie” Murdaugh, and younger brother, Paul Murdaugh, being shot in June 2021, categorically denied any involvement in Stephen Smith’s death. "I have tried my best to ignore the vicious rumors about my involvement in Stephen Smith’s tragic death that continue to be published in the media as I grieve over the brutal murders of my mother and brother," Buster stated in 2023.
Smith, an openly gay teenager and former classmate of Murdaugh, was found dead from a blow to the forehead, which an independent autopsy confirmed was likely from a hit-and-run. Despite these findings, Murdaugh claims the documentaries falsely portrayed him as Smith’s murderer. On a pivotal day in federal court, Alex Murdaugh, the disgraced former personal injury attorney, was sentenced to an additional 40 years in prison, culminating in a total of 480 months behind bars. This stern judgment was passed down by U.S. District Judge Richard M. Judge Gergel expressed his determination to enforce a sentence of 480 months, alongside mandatory restitution surpassing $9 million, aimed at compensating the victims of Murdaugh's extensive financial misdeeds. However, recognizing Murdaugh's incapacity to fulfill this restitution, Gergel opted to waive the fee, mandating instead that Murdaugh immediately pay a $2,000 special assessment.
In court, Murdaugh expressed deep remorse for his actions, stating, "I do want you to know and all of the victims to know I am filled with sorrow. I am filled with remorse. I am filled with guilt."
Jim Griffin, Murdaugh's attorney, voiced uncertainty regarding the actual duration Murdaugh would serve of the 40-year sentence, noting the federal system's practice of inmates serving roughly 60% of their sentences, which could potentially reduce Murdaugh's time in prison to 24 years. "Things can change over time," Griffin remarked outside the Charleston courthouse.
The sentencing drew reactions from various quarters, including Eric Bland, a lawyer representing the victims of Murdaugh's financial crimes. Bland found it "offensive" to compare Murdaugh's victims to those of high-profile financial criminals like Bernie Madoff or the Enron executives, emphasizing that Murdaugh's victims had suffered personal losses, not just financial setbacks.
Murdaugh, aged 55, is concurrently serving a life sentence without the possibility of parole for the June 2021 murder of his wife, Maggie, and their youngest son, Paul, a crime prosecutors argue was an attempt to divert attention from his unraveling financial misdeeds.
Additionally, Murdaugh faced a 27-year sentence in a state case for his financial crimes, handed down last November. Despite federal prosecutors recommending a 17 to 22-year sentence for Murdaugh's near two-dozen crimes, including bank fraud and money laundering, a recent development saw allegations of Murdaugh failing part of a polygraph test, potentially breaching his plea agreement.

In a significant development following the legal saga surrounding convicted murderer Alex Murdaugh, a court order issued on February 5th has allocated almost half of his remaining assets to victims of a deadly 2019 boat accident, according to the Post and Courier.
The court order, stemming from a tragic incident where a boat driven by Murdaugh's son, Paul, crashed into a bridge piling, allocates 29% of the funds to the family of Mallory Beach, who lost her life in the accident. Mallory's family has expressed that their pursuit was more about accountability and setting a precedent than about the money itself.
"From the Beach's perspective, it really was never about the money," remarked Beach family attorney Mark Tinsley. "It was all about accountability and precedent, and making an example in the hopes that before someone allows their kid to live dangerously and drink and drive, and enables them to engage in this unlawful conduct, that somebody will take stock of what happened and that you can lose everything."
Tinsley emphasized that while the monetary compensation is significant, the greater comfort lies in the acknowledgment of accountability and the potential deterrent effect on similar incidents in the future.
The disbursement also includes 11% for Paul Murdaugh's then-girlfriend, Morgan Doughty, and 5% for another survivor, Miley Altman, totaling 45% for victims of the boat crash and their loved ones. These funds, totaling just under $1.8 million, were garnered from the sale of some of Murdaugh's properties and farm equipment, as well as from a 401(k) plan.
The disbursement of assets comes amidst a backdrop of legal turmoil for Murdaugh, a well-known attorney in the South Carolina Lowcountry region. His legal troubles escalated after he claimed to have discovered his wife, Maggie, and youngest son, Paul, shot to death on their hunting lodge grounds in June 2021. Subsequently, Murdaugh was indicted for their murders in July 2022 and found guilty in March 2023, receiving a life sentence without parole.
In November, Murdaugh pleaded guilty to 22 financial crimes, including wire fraud and money laundering, totaling a separate chapter in his legal entanglements. His assets were seized in November 2021 amid ongoing investigations into his financial misconduct.
The disbursement of assets represents a significant step in bringing closure to the victims of the boat accident while underscoring the multifaceted legal challenges faced by Murdaugh.
